CashbackPlus App Service Policy

Welcome to CashbackPlus!

This "User Service Agreement" ("Agreement") is a legally binding contract between you and CashbackPlus. It governs your access to and use of our reward system ("Cashback") and related features ("Services") provided through the official CashbackPlus website, browser extensions, and mobile applications (collectively, the "CashbackPlus Platform").

Please read this Agreement carefully. By accessing or using any part of the CashbackPlus Platform, or maintaining your CashbackPlus profile, you confirm that you have reviewed, understood, and agreed to all terms of this Agreement.

CashbackPlus reserves the right to modify this Agreement from time to time, with or without prior notice. Your continued use of any Service or maintenance of your profile constitutes your formal acceptance of all revised terms.

1. License to Use Services

CashbackPlus grants you a limited, non-transferable, revocable (without sublicense rights) license to access and use the CashbackPlus Platform strictly for personal, non-commercial purposes. This Agreement does not transfer any ownership or intellectual property rights. CashbackPlus reserves the right to change, enhance, or terminate any part of the platform or services at its sole discretion. All intellectual property rights not expressly granted are retained by CashbackPlus and its licensors.

2. CashbackPlus Profile

Access to specific Services requires you to create a CashbackPlus profile. You can create a profile for free by providing the necessary personal information. Profile creation and eligibility for rewards are entirely at the discretion of CashbackPlus and contingent upon your compliance with this Agreement.

Uniqueness Limitations:

• Each user is limited to one CashbackPlus profile.
• Each unique mobile number and financial account (e.g., bank account or e-wallet) can only be associated with one profile.

Compliance Requirements: Any deceptive practices, abuse of the reward system, or submission of false information may result in the suspension or termination of your profile and immediate forfeiture of all accumulated cashback.

Reward Monitoring: You are responsible for regularly checking your profile to ensure the accuracy of reward records. Any discrepancies must be reported to CashbackPlus within 24 hours of the event. CashbackPlus is not obligated to process errors reported beyond this period.

3. Cashback Rewards

CashbackPlus allows you to earn cashback on eligible purchases from partner merchants through our platform. Participation in this service requires an active profile. Cashback accrual is governed by specific criteria:

• Activation of tracking technology (cookies) during navigation.
• Avoiding the use of auxiliary browser windows after redirection to the merchant's site.
• Completing transactions immediately after redirection.
• Adherence to specific time limits.
• Maintaining honest conduct and complying with merchant-specific rules. Please note that certain purchases may not be eligible for rewards. Typically, cashback is calculated based on the net transaction value, excluding taxes and shipping. CashbackPlus is not responsible for promotional changes or omissions on the merchant's part. Common exclusions include using unauthorized discount codes, purchases with specific payment methods, or transactions deemed manipulative by CashbackPlus.

4. Third-Party Merchant Agreements

Your transactions with partner merchants are governed by their independent policies, including their return and shipping terms. You understand that CashbackPlus does not act as an agent for these merchants; they operate as independent entities and are not subject to our oversight. Therefore, your interactions with any merchant are solely between you and the merchant. CashbackPlus disclaims all liability for the quality, legality, modifications of merchant products, or adjustments to rewards due to changes on the merchant's part.

5. Reward Adjustments and Balance

CashbackPlus reserves the right to deduct or adjust profile balances at its sole discretion. This includes correcting technical errors in reward attribution or addressing instances of non-compliant and fraudulent user activity.

6. Reward Redemption

You may request payment of accumulated cashback in accordance with this Agreement or specific participation conditions. Payments are subject to a minimum withdrawal threshold, which may be adjusted by CashbackPlus from time to time. To ensure smooth transfers, you must maintain a functional profile and provide accurate financial information (e.g., bank account details or e-wallet identifiers).

7. Legal Status of Rewards

For the avoidance of doubt, accumulated cashback does not constitute ownership of CashbackPlus company assets. Accumulated balances are not held in trust for you. Your interest is limited to a contractual right to request payment in accordance with the terms of this Agreement.

8. Profile Deactivation and Dormancy

If your CashbackPlus profile has no successful transactions for twelve consecutive months, all balances within it will be forfeited. Cashback Plus reserves the right to deactivate profiles in accordance with applicable local laws or judicial orders.

9. Privacy and Data Governance

All personal information processing is governed by our Privacy Policy, which is incorporated into this Agreement by reference.

10. Incentive and Referral Programs

CashbackPlus may introduce rewards (e.g., user invitations) from time to time. These rewards are subject to the specific terms of the offer. Users are strictly prohibited from using "CashbackPlus" brand keywords for paid search traffic or distributing referral links on unauthorized forums or merchant social media channels.

11. Financial Responsibility (Taxes)

You bear full responsibility for any tax liabilities arising from the redemption of cashback. CashbackPlus provides no guidance or guarantees regarding the tax treatment of these funds.

12. Fraudulent Activities

Any evidence of fraudulent activity will result in the immediate suspension of your profile. Violations of this Agreement, systematic abuse of the reward system, or misrepresentation of data will lead to account closure and the complete loss of all earned incentives.

13. Third-Party Rights

This Agreement does not grant any enforceable rights to individuals who are not formal parties to this contract.

14. Communications

By registering, you authorize CashbackPlus to send you operational updates (e.g., reward records and payment confirmations) and marketing materials. We may use your registration data to contact you via postal or electronic channels. You agree that electronic notifications satisfy any legal requirement for written communication and commit to maintaining an up-to-date email address.

15. Intellectual Property and Ownership

All platform content, technology, and branding are the exclusive property of CashbackPlus or its licensors. CashbackPlus reserves all trademark rights, both nationally and internationally. Unauthorized use of the CashbackPlus logo or bidding on similar keywords (e.g., "CashbackPlus.my") in search engines is strictly prohibited without express written permission.

16. Community Guidelines

CashbackPlus promotes a respectful environment. Users are prohibited from disseminating content containing hate speech, obscenity, or harassment directed at our employees, partners, or other users. Furthermore, you may not use the platform to promote "get-rich-quick" schemes or defamatory statements. CashbackPlus reserves the right to terminate user access for violations of these guidelines at its sole discretion.

17. Legal Indemnity

You agree to protect, defend, and hold CashbackPlus and its affiliates harmless from any legal claims, losses, or expenses (including reasonable attorney fees) arising from your breach of this Agreement or your conduct on the platform. CashbackPlus reserves the option to manage the legal defense of any such matters.

18. Disclaimer

The CashbackPlus Platform and all associated content are provided "as is." We disclaim all warranties, express or implied. We do not guarantee that the platform will be uninterrupted, free of malware, or error-free. CashbackPlus does not endorse the quality or suitability of third-party products discovered through our services.

19. Digital Security and Third-Party Authentication

You may access CashbackPlus through third-party credentials (e.g., Google or Facebook) or biometric hardware. You are responsible for the security of your device. Biometric data is managed locally by your hardware; CashbackPlus does not store such data. You acknowledge that CashbackPlus is not responsible for subsequent unauthorized access to your rewards if your device or third-party account is compromised.

20. Limitation of Liability

To the maximum extent permitted by applicable local law, CashbackPlus is not liable for incidental, indirect, or consequential damages. Our total cumulative liability for any claims arising from this Agreement is capped at one hundred US dollars (USD 100).

21. Jurisdiction and Dispute Resolution

This Agreement is governed by local law. Any conflicts regarding the interpretation or validity of this contract shall be submitted to the Singapore International Arbitration Centre (SIAC) for final arbitration.

• Arbitral Tribunal: One (1) arbitrator.
• Language: English.
• The arbitrator possesses the exclusive authority to determine the arbitrability of any claim.

22. General Provisions

• Assignment: You may not assign your contractual obligations without our written consent.
• Headings: Section headings are for reference only and do not define the scope of the terms.
• Severability: If any part of this contract is found invalid by a court, the remaining parts remain fully enforceable.
• Entirety: This document represents the complete understanding between the parties and supersedes all prior discussions.
